Last May, Elon Musk claimed that he would be selling his $100 million real estate portfolio in order to prioritize funding a colony on Mars. His motivation in selling off his "earthly possessions" is to emphasize the intentions and intensity regarding his mission of moving humans to Mars. Musk has since sold most of his properties including Gene Wilder’s former Los Angeles home for $7 million. However, the final remaining residence awaiting purchase is his “special place” in San Francisco.

In 2017, the business magnate purchased a lavish San Francisco home for $23.4 million, reportedly designating the property for events. In May of 2020, after publicly announcing the sale of his real estate portfolio, Musk listed the property for $35 million. A deal had not yet been closed in the months following leading him to eventually remove the listing in November. Yesterday, Musk once more listed the home at heightened price of $37.5 million. Reportedly, Musk currently resides in a Boca Chica, Texas property rented from his aerospace company SpaceX for less than $50 thousand.

Located south of San Francisco, Musk’s former “special place” is a historic 100-year-old mansion in Hillsborough. Spanning 16,000 square feet and 47 acres of land, the extravagant property includes 10 bedrooms and 9.5 bathrooms. One of Compass Real Estate’s Core Principles is “Learning From Realty.”  While this is a rule the company uses in listening to us, as agents, it’s also a good rule of thumb for agents. After losing a number of multiple-offer bids, here is what I have learned while representing buyers in the most competitive market in the US.

With the stiff, almost cutthroat, competition we are seeing in Austin's housing market, here is a list of best practices that we will use to ensure you have the best chance of actually winning the house of your dreams.

1) Be prepared to offer well over asking.  Since January 2021, I have been seeing homes selling for 10 to 25 percent or more over the list price. That may mean we need to search for homes that are priced significantly below your approved budget in order to even have a shot at winning.

2) Waive your right to terminate if the property doesn’t appraise. The truth is, with prices escalating so quickly, homes will not appraise.  Why? Because coms are lagging indicators. Appraisers use SOLD comparables when determining appraised value and they look back six months.  That means the houses selling today are outpacing the comps. It will take several months—at least—for comps to catch up. But, if you want to win, you must be ok with waiving an appraisal.  NO ONE is accepting offers that are not using the appraisal waiver.

3) Make sure you have the cash to make up the difference between the appraised value and the contract price.  Sellers will require you to show proof that you have that cash on hand—called proof of funds. Typically, this means showing the seller a copy of your bank statement with a cash balance that is in excess of the cash down payment PLUS an amount sufficient to cover the appraisal gap.  Without this, the seller will reject your offer.

4) Waive buyer’s approval. Whoa! What? If you are not paying all cash for your new home, you should have gone through underwriting with your lender so that you are FULLY approved and ready to go. Sellers want guarantees that you are able to complete the transaction and will not terminate because you can’t get approved for the loan. This is RISKY, but as long as you feel secure in your ability to complete the transaction and you have that discussion with your lender, making a contract NOT subject to you being approved will give you a competitive edge. As a reminder, a pre-approval letter from your lender MUST be submitted with your offer. Using a trusted local lender is critical and can be the difference between winning and losing the bid.

5) Pay for all the “seller” expenses. This is a big one. In a normal market, it is common to write a contract with the seller paying for the owner’s title policy, a new survey if needed, a home warranty, HOA documents and transfer fees. Forget about that in this competitive environment. Those expenses have always been negotiable, but today, I recommend all buyers offer to pay these expenses. Remember, the goal is to make your offer most attractive to the seller.

6) Increase your earnest money to at least 2 percent if not more. If the contract terminates, the earnest money is returned to the buyer in most circumstances, so it’s a fairly low-risk strategy. To the seller, it shows you have more “skin in the game” and can be a competitive edge in helping you win. Remember, if the deal does go through, this money is credited to your purchase price and closing costs.

7) Offer a VERY large option fee for as few days as is reasonable. I have seen some contracts waive their option period. I DO NOT recommend this unless you are a builder, an experienced remodeler, or perhaps if you are buying new construction or are going into a home that you know you plan to totally remodel. Otherwise, I can’t, in all good conscience, recommend this. Instead, offering a very large option fee ($5,000, $10,000, etc.) for a few days is a good strategy.  The key is to have an inspector lined up and ready to go the minute the contract is executed and knowing, what, if anything, would cause you to walk away.

8) Get creative. Some buyers in today’s market have even offered to pay the agents’ commissions and the sellers’ moving expenses just to win the deal. What extra things can you throw in to the offer?

9) At the end of the day, cash is king.  Paying all cash for your home is one of the best competitive strategies available. Not everyone can do this of course, but if you are in a position to do that, do it and be prepared to show proof of funds.

10) Pray. It can’t hurt!

Dan Conn: "This market dropped harder and faster than any market that I can recall, and it has rebounded quicker than any time I can recall... More people in the luxury end are focused on having another home. I think that's a permanent change... If you're into the New York life, you're in the New York Life. You don't leave it... Sue Nickason: "What's interesting is the interest and the inquiries that we're getting from new markets. So obviously Hong Kong, mainland China, India, some parts of Latin America that, historically, [from which] we hadn't received a lot of interest. Those inquiries are coming through trusted advisors, such as private client lawyers, accountants, and affiliates and agents in other jurisdictions. It comes back to globally mobile affluent individuals looking to future proof in terms of residency and in terms of having a place of safe refuge such as the Cayman Islands."

Sonja Cullaro: "We have seen an influx of buyers and renters from New York City into our markets across northern New Jersey and Westchester and the Hudson Valley. It started more for short-term rentals and then it quickly morphed into buyer interest. We have seen people looking for both primary and secondary residences. When they're looking for secondary residences, it's always with an eye on the school system and the fact that the secondary residence may become a primary residence in the future.

Alex Jansen: "The Aspen market came back with a vengeance. Aspen has seen at least 100% uptick as far as under-contracts right now compared to the same time last year because there was this big lag. In April and May, the closings were very anemic, but we're seeing lots of very large properties go under contract north of $10 million, and some north of $20 million in that market. In Clearwater, the month of July is slated to be the best month on record based on volume for the Tampa Bay Area.

Brian Meier: "Since the reopening of New York City, we've been very busy. We have not seen prices drop dramatically. There have been some adjustments. It's going to need a little more time to tell where it's going to shake out, but the people who are leaving Manhattan, most of them are putting their properties on the market for rent. We have had a very slight increase in the saturation on the sales side, but we do have a lot of demand."

Texas has long been a state of resilience. Although Real Estate has always been essential, the industry recently set the tone of economic strength and sustainment during an unprecedented financial time. Despite a drop in the total number of homes sold during the month of May 2020 compared to May 2019, the total number of homes sold in the first six months of this year is still 3% higher than the total number at this point last year, according to the San Antonio Board of Realtors’ Multiple Listing Service (MLS). The COVID-19 Pandemic certainly brought about an abundance of uncertainty. However, agents saw many homeowners gain clarity on how they live in their homes. For many homeowners, this was the first time they were forced to stay home for long periods of time. Due to this, many analyzed where they were living and how that affected their quality of life. Homeowners began to think about what kind of home they actually desire and as a result, began house hunting. These changes have manifested in different ways, but there are also many commonalities among them. Here are some of the most common things we have seen buyers searching for lately:

Lockdowns and quarantine have caused many younger adults to move back in with their parents. Many have found this to be a difficult adjustment over the last few months. As a result, many people are placing a high value on guest houses for their adult children to utilize for extended stays.

Community recreation facilities are becoming a thing of the past. This is not only due to the closure of many community amenities during COVID-19, but also to the fact that people are much more health-conscious now than before. Therefore, amenities like swimming pools and workout areas are especially highly desired features of private houses right now.

Home offices have also been rather popular in recent years as working from home became more commonplace, but this popularity has morphed into a near necessity for home buyers. In fact, many buyers are now seeking out dual home offices so that they and their spouse can both effectively work from home.

These are personal stories we have heard from our clients at Phyllis Browning Company, and those sentiments are the driving force behind our current area market statistics. In the San Antonio Area, the total number of homes sold in June is up 28% from May 2020 and up 5% from June 2019. The selling price is also up 6% in June from June 2019 according to MLS data. How has the luxury real estate market in Houston been performing so far in 2020?

Luxury homes have been selling well. In particular, the new construction market has performed very well lately.  While our market was affected by Hurricane Harvey, it seems to be recovering well. Luxury buyers are move-up buyers, and the market is strong for the homes that they are moving out of, too.

What are buyers looking for in their homes in Houston in 2020?

It depends on their price range. Mid-level buyers are choosing older homes that have been beautifully remodeled and are in a good school district. There is an in-between market of homes built in the 1990s–2000s that buyers also like to transform to a more current look. Buyers at a higher price point are attracted to new construction with a sleeker look and more modern finishes.  The emphasis on having a large yard seems to have diminished somewhat – although some yard space is desired, with room for a pool along with an outdoor living space and outdoor kitchen for entertaining. Dining rooms with glass-walled wine rooms like you might see in a restaurant are a popular trend.

Which has been a highlight sale for you so far in 2020? 

New construction in a close-in neighborhood within walking distance to shops and restaurants. The buyers moved from an older home on over 2 acres in a highly desirable school district to a close-in area where people utilize excellent private schools. It’s an amazing modern house with a room for a pool, a high-end outdoor living area, and, of course, a glass-enclosed wine room viewed from the dining room.

Are there any new restaurants or other spots in Houston you’ve been loving lately?

Houston has an ever-changing restaurant scene. Areas like City Centre are home to luxury hotels like Hotel Zaza, and the accompanying restaurants that go along with mixed retail and upscale housing development. People eat out a lot in Houston and we have a huge selection of every kind of food imaginable.

It’s time for spring break. What is a fun activity in Houston?

Houstonians head to the beach for Spring Break. Or to the ski slopes. A large number of people here have second homes in Galveston as well as in Colorado. With two four-star airports within a 30-minute drive, Houston has easy access to air travel. Both airports are rated in the Top 10 in the world, and according to Skytrax, “Houston remains the only city in the Western Hemisphere with two 4-star rated airports. The only other cities in the world with two 4-star rated airports are Tokyo and Seoul.”
